- SAVANNAH, Ga. -- Savannah attorney David Eichholz improperly advised a client to accept a settlement in an auto wreck case, then directed her to a loan company his firm created and ran, a suit filed Wednesday alleges.
The action for Angelita Sanders and her husband, Mark, both of Savannah, alleges legal malpractice, fraud and usury stemming from Eichholz's representation in an April 1, 2009, wreck.
In addition to David Eichholz, the suit names the Eichholz Law Firm and Pacific Legal Funding as defendants.
David Eichholz is identified in the suit as CEO of the Eichholz Law Firm.
His father, Benjamin Eichholz, was disbarred in June after he voluntarily surrendered his license upon his conviction in federal court for obstruction of justice.
He put his son in charge of the firm before he began serving a 21-month sentence at a federal prison in Estill, S.C.
David Eichholz on Thursday referred all comment to his attorney, Doug Herman.
Herman said, based on the facts presented to him by his client and a review of the suit for the first time Thursday, he anticipates preparing a vigorous defense for Eichholz and his firm.
According to the suit filed in Chatham County Superior Court by attorney Mark Tate, Angelita Sanders went to David Eichholz after she was injured when her 2004 BMW was rear-ended in a three-car collision on Abercorn Street.
Eichholz told the Sanders' to execute a release, leaving $100,000 in potential liability resulting in them being unable to recover all available insurance, the suit contends.
Eichholz then advised the couple to obtain two loans from Pacific Legal Funding totaling $3,250, but at a 50 percent interest, the suit contends.
Eichholz did not disclose that Pacific Funding was "essentially run" out of the firm, nor that the firm benefited financially from the loans, the suit alleges.
Tate's suit contends the defendants violated their duty of "care, skill and diligence" to the Sanders' and engaged in fraud.
It seeks unspecified damages.
An attached affidavit from Savannah trial attorney Tom Taggart said the defendants' conduct deviated from the standard of care owed by lawyers to clients and placed the attorney's "own financial interest ahead of his or her clients."
And Jackqueline German, who worked for the Eichholz firm for about 15 years, said in another affidavit that Benjamin Eichholz instructed her to create Pacific Legal Funding and used his credit card number for the initial fee.

An Aiken Regional Medical Centers doctor was jailed over the weekend after an alleged attack on the home of a former girlfriend.
Dr. Edwin V. Martinez de Andino, 47, of Meadow Drive in Aiken, is charged with first- degree burglary and two counts of malicious injury to personal property after an alleged attack in the early hours of Sunday morning.
